Overtime Pay Litigation Successes for Federal Employees
Several years ago, Kern Law Firm PC along with co-counsel litigated a lawsuit under the Fair Labor Standards Act (FLSA) and the Custom Officers Pay Reform Act (COPRA) on behalf of a nationwide class of current and former Canine Enforcement Officers (dog handlers) employed by Customs and Border Protection (CBP) of the Department of Homeland Security. The case concerned unpaid off-the-clock work performed by federal dog handlers in connection with various dog training activities. This case was vigorously litigated by the U.S. Attorney’s Office and proceeded to trial in the Court of Federal Claims in Washington, D.C., where the trial court heard testimony from representative plaintiffs and ruled in favor of the class. The United States appealed the trial court's decision to the United States Court of Appeals for the Federal Circuit which affirmed the trial court’s ruling in favor of the plaintiffs. The government subsequently settled the case very favorably with the nationwide group of dog handlers who opted in to the lawsuit.
Kern Law Firm PC along with co-counsel filed another lawsuit under the FLSA and other federal pay laws on behalf of a nationwide group of current and former employees of CBP for unpaid training time. Several hundred CBP Officers joined the lawsuit during the opt-in period. This lawsuit also was aggressively opposed by the U.S. Attorney’s Office and litigated vigorously in the Court of Federal Claims ultimately producing a very favorable settlement on behalf of the participating Customs Officers.
More recently, Kern Law Firm PC along with co-counsel aggressively litigated two wage and hour collective actions in the Court of Federal Claims on behalf of federal truck drivers who worked for the Army Airforce Exchange Services (AAFES). Hundreds of federal truck drivers participated in these actions against AAFES which ultimately secured very favorable settlements on their behalf.


Victories for Municipal Police Officers and Private Correctional Officers
Kern Law Firm PC along with co-counsel has litigated several overtime-pay lawsuits under FLSA and applicable Texas state laws on behalf of current and former municipal police officers employed by cities in Texas. Nearly 2,000 individual police officers opted into these cases. Among other claims, these lawsuits primarily concerned claims for unpaid off-the-clock time for pre-shift and post-shift briefings. In these cases, after vigorous and aggressive litigation, the participating municipal police officers received very favorable recoveries for their unpaid off-the-clock work.

These cases were brought under the FLSA and applicable New Mexico state laws on behalf of current and former private correctional officers who were required to perform some of their work off-the-clock and without pay. Many hundreds of private correctional officers from different states joined in these lawsuits which secured favorable recoveries for the correctional officers for their unpaid off-the-clock work.
